⚖️ Introduction
In Pakistan, property inheritance (Warisnama) is governed by Islamic Sharia Law (Faraid). Every Muslim’s estate must be divided strictly according to the Qur’an (Surah An-Nisa 4:11–12, 4:176) and Hadith principles.
For property owners in DHA Lahore, understanding these rules is essential for smooth property mutation, file transfer, or family settlements after a relative’s death.
At Islam Estate®️, we help families process inheritance (Warisnama) cases in DHA offices and ensure rightful distribution among all legal heirs.

Blocking Rules (Hijab System)
Some heirs can block others from inheritance due to their closer relationship to the deceased.
Examples:
- Son blocks: grandson, granddaughter, brothers, sisters, nephews, and uncles.
- Father blocks: grandfather, grandmother, brothers, sisters, and nephews.
- Mother blocks: paternal and maternal grandmothers.
- Full Brother blocks: paternal brothers/sisters and nephews.
- Grandfather blocks: nephews and uncles.
👉 Note: The following heirs can never be blocked:
Husband, Wife, Father, Mother, Son, and Daughter.
⚙️
Residual and Ta’sib Rules (Shared Distribution)
- Males and females of the same class share 2:1 (as per An-Nisa 4:11, 4:176).
- Applies to sons/daughters, grandsons/granddaughters, brothers/sisters.
- Does not apply to maternal siblings.
- Father and grandfather are never excluded from inheritance.
- In Awal cases, when total shares > 1, all shares are reduced proportionately.
- In Radd cases, when total shares < 1, all shares (except spouse) are increased proportionately.
- Spouse’s share is fixed and can never increase beyond its Qur’anic limit.
🧮
Special Scenarios
Umar’s Fatawa Case
When deceased leaves father, mother, spouse, and multiple siblings:
- Parents share remainder 2:1 (Father:Mother) after spouse share.
- Siblings reduce the mother’s share to 1/6.
Grandfather vs. Siblings
When no father exists but grandfather and siblings do:
- Grandfather receives the greater of 1/6, 1/3 remainder, or equal brother share.
Female Heirs’ Limitation
- Inheritance stops at female heirs (their children do not inherit through them).
- Male lines continue (e.g., son → grandson → great-grandson).
